Privacy Policy

Current terms regarding the collection, processing, and protection of personal data for EdgeNode users.

This Privacy Policy governs the collection, processing, storage, and protection of personal data and other information submitted by users when interacting with the EdgeNode executable digital twin builder (hereinafter referred to as the “Service” or “Builder”).

Use of the Service constitutes unconditional agreement with the terms of this Policy and the End User License Agreement (EULA). This Policy forms an integral part of the EULA.


1. Definitions

The terms used in this Policy correspond to the definitions established in the EULA:

User
An individual or legal entity that has registered an Account in the Builder.
Account
A User’s personalized access point to Builder features, secured by authentication credentials.
Personal Data
Any information relating directly or indirectly to an identified or identifiable natural person.
Model
A structured representation of a business process or IT architecture created by the User within the Builder.
Output Document
A diagram or analytical report generated by the Builder based on a Model (including, but not limited to, BPMN 2.0, UML, ArchiMate, and RACI specifications).
Service
The collection of software, technical, and informational resources that enable the operation of the Builder.

2. Scope of Collected Data

The Service collects and processes the following categories of information:

  • Registration Details: Full name, email address, occupation, country of residence (for individuals), or country of incorporation (for legal entities).
  • Technical Information: IP address, browser type and version, operating system, session metadata, access logs, device specifications, and network parameters.
  • Usage Data: Information concerning created Models, initiated simulation runs, generated Output Documents, subscription plan parameters, interface preferences, and feature interaction metrics.
  • Cookies and Similar Technologies: Utilized for authentication, settings persistence, security enforcement, platform analytics, and fraud prevention. Users can configure cookie permissions via browser settings.

3. Purposes of Data Processing

The Service processes data exclusively for the following purposes:

  • Providing access to the Builder and fulfilling commitments under the selected subscription tier.
  • User identification, Account security verification, and mitigation of unauthorized access or misuse.
  • Technical support, issue resolution, simulation algorithm enhancement, performance optimization, and product development.
  • Generating anonymized and aggregated reports for internal research, industry analytics, and ecosystem expansion.
  • Complying with applicable statutory requirements and responding to lawful requests from authorized public authorities.

4. Legal Grounds for Processing

Data processing is conducted on the basis of:

  • User consent expressed during registration and through active usage of the Service.
  • Performance of obligations defined in the EULA and this Policy.
  • Legitimate business interests of EdgeNode LLC in safeguarding operations, refining software capabilities, and preventing violations, insofar as they do not infringe upon User rights.
  • Compliance with mandatory regulations under the laws of the User's jurisdiction.

5. Data Storage and Protection

The Service implements technical and organizational measures aligned with industry benchmarks: TLS transport encryption, credential hashing, role-based access control (RBAC), regular security reviews, and isolated processing environments.

Data is hosted in secure, certified data center facilities adhering to strict information security standards. Host locations may vary according to the User's regional registration or enterprise subscription parameters.

The User acknowledges that data transmission over the Internet inherently entails objective risks and agrees to use the Builder in accordance with the warranty disclaimer and liability limitation provisions in the EULA.

6. Third-Party Disclosures

EdgeNode LLC does not sell or rent personal data to third parties for marketing purposes. Information exchange occurs strictly under the following circumstances:

  • With affiliates and operational service providers (cloud infrastructure, payment processing, technical support desks, monitoring utilities) bound by data protection and confidentiality covenants prohibiting data use outside the purposes outlined in this Policy.
  • Pursuant to compulsory requests by competent state authorities in accordance with mandatory legislation in the User's jurisdiction.
  • In events involving corporate restructuring, merger, or asset acquisition, provided the successor maintains equivalent confidentiality commitments and notifications are issued in accordance with the EULA.

7. User Rights

Under applicable legislation, Users possess the right to:

  • Request confirmation regarding the fact, objectives, and methods of their data processing.
  • Rectify inaccurate or incomplete information directly via the account interface or through customer support.
  • Demand deletion of their Account and associated records, except where continued retention is required by statute, for dispute resolution, or to safeguard legitimate legal claims.
  • Restrict processing or revoke consent regarding analytical cookies and platform telemetry tools.
  • Request data portability in a machine-readable format, where technically viable and without prejudicing third-party rights.

All inquiries must be submitted using the contacts designated in Section 11 of this Policy. Inquiries are reviewed within statutory deadlines.

8. Retention Periods and Erasure

Personal data is retained until the User deletes their Account or the EULA is terminated.

Following Account deletion, Models, Output Documents, and user profile data are purged from the active Builder production environment within 30 days. System backups are automatically overwritten and destroyed within an additional 90 days pursuant to the corporate backup rotation policy.

Records required for accounting, tax verification, dispute settlement, fraud prevention, or statutory regulatory mandates may be preserved for durations prescribed by applicable law.

9. Cross-Border Data Transfers

If data transfer to jurisdictions outside the User’s territory of residence is necessary, EdgeNode LLC guarantees adequate safeguards, including standard contractual clauses, encrypted communication channels, access restrictions, and periodic compliance verifications in accordance with applicable data protection laws.

10. Policy Amendments

EdgeNode LLC reserves the right to modify this Policy. Revised editions are published on the website displaying the updated revision date. Continued engagement with the Builder after changes take effect constitutes acceptance of the amended terms. If material adjustments affect User rights, notifications will be delivered through the Service dashboard or sent to the primary email registered to the Account.
